能源法元规则的付之阙如，乃是当前能源法学规则命题冲突和理论体系难以有效构建的核心问题。因此，惟有将能源革命表征化和常态化的术语即能源变革，确立为能源法的元规则，才有助于解决这一问题。而能源变革一语之所以具备承担这一元规则的基本要义，则不仅是经由对变化问题的哲学和法学理论谱系拷问所得，而且亦是被工业革命和美国页岩革命的事实所印证的。因此，未来能源法体系构建中，应适时确立起能源变革的元规则地位，以期促成中国能源革命的常态化发展。

On Meta-Rule of Energy Law: from the Contextual Reality Perspective of Energy Transformation

Abstract: the conflicts of rule theses in energy law system largely lie in no meta-rule thesis. Therefore, it is crucial to building right meta-rule of energy law for solving those antithetic rules. Among the energy rule theses, energy transformation is chose as the meta-rule language. This result is not only from the theory support in philosophy and jurisprudence, but also from historical experience. So, it should be recognized that energy transition is the meta-rule of energy law in the energy law system.
