随着联合国气候变化谈判进程的继续，国际法下的“共同但有区别的责任”原则已难以完全适应国际气候领域的诸多变化。因此，重构这一原则，无疑成为达成新的国际气候协议的关键。然而， 目前国际社会提出的种种制度性设计均无法满足当前气候政治的现实要求，重构面临极大的困难性; 但是毫无疑问， 权力势必主导这一建构过程，国家也将在软硬法的相互博弈下做出选择。

Institutional Design of the Principle of Common but Differentiated Responsibility

      Abstract: With the ongoing process of international climate negotiations，the principle of common but differentiated responsibility is unable to fully adapt to the changing international realities． Therefore，it is a key for reaching a new international climate agreement to reconstruct the principle． In the process， power is bound to play a leading role，and game between countries will take place through the interaction of hard law and soft law． On such a basis，China should size up the situation and examine the institutional design of the principle of common but differentiated responsibility to meet the serious challenge of climate change negotiations．
